PRIVACY POLICY

Effective and Last Updated: September 28, 2026

This Privacy Policy explains what personal information Delusional collects when you use our games, apps and websites, why we collect it, who we share it with, how long we keep it, and the choices and rights you have. Not every Service has every feature described here. Section 4 explains what applies when a Service has a particular feature.

1. WHO WE ARE

Delusional, Inc., a Delaware corporation (“Delusional,” “we,” “us” or “our”), is responsible for your personal information (its “controller”) under this policy. You can reach us at 75 W 71st Street, 1B, New York, NY 10023, or at privacy@delusional.gg.

2. SCOPE

This policy applies to every game, app, website and service published by Delusional, Inc., under any brand and on any platform, now or in the future (the “Services”). Use of the Services is also governed by our Terms of Service.

App stores and platforms such as Apple, Google and Valve (Steam) process your payments and platform accounts under their own privacy policies. This policy does not cover them, or any third-party websites or services linked from the Services.

3. WHAT WE COLLECT

3.1 Information you give us

  • Sign-in details when you sign in with Apple, Google, Steam or another platform: an account identifier and, depending on the platform and your choices, an email address (which may be a private relay address) and your name.
  • Names and profile: usernames, display names, handles, avatars and anything else you add to a profile.
  • Content you create: games, levels and other creations, comments, messages and text chat.
  • AI prompts and images you submit to AI features, and the output generated for you.
  • Voice, when you use voice chat.
  • Support and feedback: emails and messages you send us, and answers to surveys or onboarding questions.

3.2 Information collected automatically

  • Device and app identifiers: identifiers such as the identifier for vendor (IDFV), platform and player IDs, installation IDs and push notification tokens. Your device’s advertising identifier (such as Apple’s IDFA or Google’s advertising ID) is collected only with your permission where the platform requires it.
  • Network and location: your IP address, and the approximate location (such as country, region or city) derived from it.
  • Device information: device model, operating system, language, time zone and app version.
  • Gameplay and usage: sessions, screens viewed, buttons tapped, matches, levels, scores, progress, in-game purchases and spending, and interactions with ads.
  • Purchase records: what you bought, when, the price and the transaction identifiers.
  • Crash and performance data, and server logs of requests to our systems.

3.3 Information from partners

  • Platforms and purchase processors: purchase receipts, subscription status and refunds.
  • Sign-in providers: the identity details described in Section 3.1.
  • Attribution and advertising partners: which ad or campaign led to your install, and information about ads you saw or interacted with in the Services.

3.4 What we don’t collect

We do not currently collect precise (GPS) location, your contacts or health data, and we do not use your voice or images to identify you. If a Service starts collecting a new kind of personal information, we will update this policy first. We access your camera, photos or microphone only when you choose to use a feature that needs them.

4. FEATURES: IF A SERVICE HAS…

4.1 Accounts and guest play

Some Services let you sign in with a platform account; others create an anonymous guest account for you, tied to your device or installation. We use your account to save and sync your progress, items and purchases. If you lose access to a guest account (for example by deleting the app or changing devices), we may be unable to recover it.

4.2 Public content, profiles and leaderboards

Names, avatars, profiles, published creations, comments, scores, ranks and leaderboard entries can be seen by other users, and some may be visible to anyone on the web. Public content is moderated, including by automated tools, and other users can report it. Leaderboards may also include computer-controlled players (see our Terms of Service). Your email address and purchases are never shown publicly.

4.3 Multiplayer

To match you with other players and run online sessions, we process your account or player ID, skill and progress data, region, connection quality and match results. Some Services connect players’ devices directly (peer-to-peer). In a peer-to-peer session, other players’ devices can see your IP address, which may reveal your approximate location. We also use match data to detect cheating.

4.4 Chat and messages

We store text chat, messages and comments so we can deliver and display them. They may be automatically screened for safety, and reported messages may be reviewed by our team.

4.5 Voice chat

Voice chat is relayed live between players, directly or through voice infrastructure providers, and is not recorded or stored by us. Short in-game replays are not kept. Other players can hear what you say, and we cannot stop them from recording it on their own devices. You can mute other players, or turn voice chat or microphone access off in the Service or your device settings.

4.6 AI generation

When you use an AI feature, your prompts, any images you upload, and the context needed to generate a result are sent to AI model providers (such as Anthropic, OpenAI and Google), which act as our service providers to generate the output. We ask your permission in the Service before your data is first sent to them. Prompts and output are moderated, which may involve the providers’ moderation services. Please do not include personal information about yourself or others in prompts or uploads.

4.7 Advertising and attribution

  • Ads. If a Service shows ads, ad networks and mediation platforms (such as AppLovin, Google AdMob and Unity Ads) receive device information, your IP address, and your interactions with ads, to show ads, cap how often you see them, detect fraud and measure results. They use your advertising identifier for personalized ads only if you allow it.
  • Attribution. To learn which of our ads bring in new players, attribution partners (such as AppsFlyer) receive your install and key in-app events (such as sign-up, first play and purchases), device information, your IP address and your account ID. The ad platforms we advertise on (such as Meta, Google and TikTok) may learn that an install or event came from one of their ads.
  • Your permission. On iOS, your advertising identifier (IDFA) is collected only if you allow tracking when Apple’s App Tracking Transparency prompt asks. If you don’t, Apple’s aggregated measurement (such as SKAdNetwork and AdAttributionKit) is used instead. On Android, you can reset or delete your advertising ID in your device settings. In the European Economic Area, the UK and Switzerland, we ask for your consent through a consent form before personalized ads are shown or your data is used for them, and you can change your choice in the Service’s privacy options.

4.8 Analytics and crash reporting

We use analytics and crash reporting providers (such as PostHog and Unity Gaming Services) to understand how the Services are used, balance games, fix bugs and improve performance. Events are linked to a pseudonymous account or device ID.

4.9 Purchases

Payments are processed by the app store or platform. Your card and payment details stay with them, and we never receive them. We receive a record of your purchases, directly or through purchase and subscription processors (such as RevenueCat), to deliver and restore what you bought, manage subscriptions, prevent fraud and handle refunds. Purchase events may also be reported to attribution partners as described in Section 4.7.

4.10 Push notifications

If you allow notifications, we store a push token for your device so we can send you notifications, such as game reminders, activity from other players and offers. You can turn them off at any time in the Service or your device settings.

5. HOW WE USE IT

We use personal information to:

  • provide and operate the Services, including accounts, progress, multiplayer, chat, AI features and public content;
  • process and deliver purchases and subscriptions;
  • keep the Services safe and fair, including moderation, anti-cheat, and enforcing our Terms;
  • prevent fraud, abuse and security incidents;
  • analyse, personalize and improve the Services and develop new ones;
  • show ads and measure how well our advertising works;
  • communicate with you and provide support; and
  • comply with the law, respond to lawful requests, and establish or defend legal claims.

We use automated systems to detect cheating and to screen content, and these can lead to content being removed or accounts being restricted. You can ask for a human review by emailing privacy@delusional.gg.

Legal bases (EEA, UK and Switzerland). Where these laws apply, we rely on:

  • Contract: to provide the Services and purchases you ask for;
  • Legitimate interests: safety, anti-cheat, fraud prevention, security, analytics, improving the Services, non-personalized advertising, and marketing our own Services, where those interests are not overridden by your rights;
  • Consent: where the law requires it, such as for tracking and personalized ads, sharing prompts and uploads with AI model providers, and push notifications. You can withdraw consent at any time; this does not affect processing that happened before;
  • Legal obligation: to comply with the law.

6. WHO WE SHARE IT WITH

We share personal information with the following categories of recipients:

  • Hosting, backend and storage providers (such as Supabase, Vercel and Unity Gaming Services);
  • App stores, platforms and payment processors (such as Apple, Google, Valve and RevenueCat);
  • Analytics and crash reporting providers (such as PostHog and Unity Gaming Services);
  • Attribution and advertising partners (such as AppsFlyer, AppLovin, Google, Meta and TikTok);
  • AI model providers (such as Anthropic, OpenAI and Google);
  • Multiplayer and voice infrastructure providers, which run matchmaking, relays and voice chat;
  • Moderation and safety providers, which help screen content;
  • Customer support and communication tools, which help us answer your emails and send notifications;
  • Other users, as described in Sections 4.2 to 4.5;
  • Legal and safety: law enforcement, regulators, courts and others, when we believe the law requires it, or to protect the rights, property or safety of our users, the public or Delusional;
  • Business transfers: a buyer, successor or investor, and their advisers, in connection with a merger, acquisition, financing, sale of assets or similar transaction; and
  • Anyone else, with your consent or at your direction.

We don’t sell your personal information for money. When a Service uses advertising or attribution partners, disclosing identifiers and activity to them may count as “selling” or “sharing” personal information for targeted advertising under California law and similar US state laws. You can opt out as described in Section 8.

7. HOW LONG WE KEEP IT

We keep personal information for as long as your account is active, and afterwards for as long as needed for the purposes in this policy, including security, fraud prevention, legal obligations and resolving disputes. For example:

  • when you delete your account, we delete or anonymize your personal information within 30 days, except as described below;
  • server logs are generally kept for up to 90 days;
  • guest accounts that have been inactive for 24 months may be deleted;
  • purchase records are kept for up to 7 years for tax, accounting and legal purposes;
  • voice chat is not stored; and
  • copies and remixes that other users already made of content you published may remain.

We may keep aggregated or de-identified information that no longer identifies you without time limit.

8. YOUR CHOICES AND RIGHTS

8.1 Deleting your data

Where a Service has accounts, you can delete your account and its data in the Service’s settings (usually Settings → Delete account). You can also email privacy@delusional.gg (or help@delusional.gg) from the email address or with the player ID shown in the Service, and we will delete your data. Deleting your account does not cancel a subscription; cancel it in your app store or platform account settings.

8.2 Device and in-game controls

  • Tracking (iOS): Settings → Privacy & Security → Tracking.
  • Advertising ID (Android): reset or delete it in your device’s privacy or Google settings.
  • Ad consent: in the Service’s privacy options, where available.
  • Notifications and microphone: in the Service or your device settings.

8.3 Your rights

Depending on where you live, you may have the right to:

  • know what personal information we have about you and access a copy of it;
  • correct it;
  • delete it;
  • receive it in a portable format;
  • object to or restrict our use of it, including for direct marketing;
  • withdraw consent;
  • opt out of the “sale” or “sharing” of your personal information, or its use for targeted advertising; and
  • appeal our decision on your request.

To exercise a right, email privacy@delusional.gg. We may need to verify your identity, for example by asking you to write from the email address or with the player ID associated with your account. You can use an authorized agent where the law allows, and we may ask for proof of the agent’s authority. We respond within the time the law requires. We will not discriminate against you for exercising your rights.

Global Privacy Control. We treat a Global Privacy Control signal from your browser as a request to opt out of the sale or sharing of your personal information for that browser, as the law requires.

Appeals and complaints. If we deny your request, you can appeal by replying to our decision or emailing privacy@delusional.gg with the subject line “Appeal.” If you are in the EEA, the UK or Switzerland, you can also complain to your local data protection authority. In some US states, you can contact your state Attorney General if you disagree with the outcome of an appeal.

8.4 California and other US state disclosures

In the past 12 months, we have collected the following categories of personal information, from the sources and for the purposes described in Sections 3 to 5:

  • Identifiers, such as account and player IDs, device and advertising identifiers, IP address and email address;
  • Commercial information, such as purchase records;
  • Internet or other electronic network activity, such as gameplay, usage, ad interaction and crash data;
  • Approximate geolocation derived from IP address;
  • Audio and visual information, such as voice relayed in voice chat and images you upload; and
  • User content, such as names, messages, creations and AI prompts.

We disclose these categories for business purposes to the categories of recipients in Section 6. Identifiers, internet activity, commercial information and approximate geolocation may be “sold” or “shared” to attribution and advertising partners when a Service uses them. We retain each category as described in Section 7. We do not use or disclose sensitive personal information for purposes that would give you a right to limit that use, and we have no actual knowledge that we sell or share the personal information of consumers under 16.

9. CHILDREN

The Services are for people aged 13 and over and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have, we will delete it. If you believe a child under 13 has given us personal information, contact privacy@delusional.gg. Users aged 13 to 17 need a parent’s or guardian’s permission to use the Services, as our Terms of Service explain.

10. INTERNATIONAL TRANSFERS

We are based in the United States, and we and our service providers process personal information in the United States and other countries whose data protection laws may differ from those where you live. When we transfer personal information from the EEA, the UK or Switzerland, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses and the UK Addendum, or on other lawful transfer mechanisms. You can ask us for a copy of these safeguards at privacy@delusional.gg.

11. SECURITY

We use reasonable technical and organizational safeguards designed to protect personal information, such as encryption in transit and access controls. No method of transmission or storage is completely secure, so we cannot guarantee the security of your information.

12. CHANGES TO THIS POLICY

We may update this policy from time to time. The date at the top shows when it last changed. For material changes, we will give notice in the Services or on this website before they take effect. Past versions are available on request from privacy@delusional.gg.
